Agreement to Terms

Welcome to AIVideo. These Terms of Service ("Terms") govern your access to and use of the AIVideo website at aiseedancev2.com and all related services, features, and content (collectively, the "Service") operated under the AIVideo brand ("AIVideo," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Description of Service

AIVideo provides a creative platform for generating videos and images with multiple artificial intelligence models. The Service allows users to create visual content from text prompts, uploaded images and other supported inputs, subject to the capabilities and availability of each model.

Third-Party Models and Trademarks

AIVideo is an independent AI creation platform. Unless expressly stated otherwise, references to third-party models, technologies, products, or brands are provided solely for identification and descriptive purposes. Such references do not imply any affiliation, partnership, sponsorship, authorization, or endorsement.

• AIVideo operates independently from third-party model and technology providers and is not their official website or authorized representative.
• Access to a third-party model through AIVideo does not imply a partnership with or endorsement by that provider.
• All third-party product names, model names, logos, trademarks, and service marks are the property of their respective owners.
• Third-party services may be changed, suspended, or discontinued and may be subject to their providers' terms and policies.

Account Registration

To access certain features of our Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You must be at least 13 years old (or 16 in certain jurisdictions) to create an account and use our Service. By creating an account, you represent that you meet this age requirement.

Credits and Payment

Credit System

Our Service operates on a credit-based system. Different models and generation options may consume different amounts of credits. The applicable credit cost is displayed in the Service before you submit a generation request and may change as models, features, or provider pricing change.

Credit validity or expiration, if any, is shown in the applicable plan details or at checkout. Credits have no cash value, cannot be transferred unless we expressly permit it, and may only be used within the Service.

Purchases

• All purchases are processed through secure third-party payment providers
• Prices are displayed in USD unless otherwise specified
• Credits are generally added to your account after successful payment confirmation
• You are responsible for any applicable taxes

Refund Policy

• Purchases are generally non-refundable except where required by applicable law
• If a generation fails because of a technical or provider error after credits have been charged, we will generally restore the affected credits; a credit restoration is not a cash refund
• Refund requests for duplicate charges or material technical issues may be reviewed on a case-by-case basis

Subscription Plans

If you subscribe to a recurring plan:

• Your subscription will automatically renew at the price and billing frequency disclosed at checkout until canceled
• You may cancel using the available account controls or the cancellation method provided by the applicable payment provider
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods except where required by applicable law

User Content and Conduct

Your Content

"User Content" means prompts, images, videos, audio, and other material you submit to the Service, together with outputs generated for you. You retain any rights you already hold in your submitted content. As between you and AIVideo, we do not claim ownership of your generated outputs.

• You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, process, transmit, and display User Content only as reasonably necessary to operate, secure, and support the Service, comply with law, and enforce these Terms
• User Content may be transmitted to and processed by third-party service and model providers as described in our Privacy Policy
• You are responsible for ensuring your prompts and uploaded content do not violate these Terms or applicable laws
• You represent that you have all rights and permissions necessary to submit User Content and authorize its processing under these Terms

Acceptable Use

You agree NOT to use our Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create deepfakes or manipulated media intended to deceive or harm individuals
• Produce content depicting minors in inappropriate situations
• Generate content that infringes on intellectual property rights of others
• Create spam, phishing content, or malware
• Attempt to bypass content filters or safety mechanisms
• Use automated tools to access the Service without our permission
• Reverse engineer, decompile, or attempt to extract source code from our Service
• Resell, redistribute, or commercially exploit the Service without authorization
• Interfere with or disrupt the Service or servers
• Impersonate others or misrepresent your affiliation with any person or entity

Content Moderation

We reserve the right to:

• Monitor and review generated content for compliance with these Terms
• Remove or disable access to content that violates these Terms
• Suspend or terminate accounts that violate our policies
• Report illegal content to appropriate authorities

Intellectual Property

Our Intellectual Property

The Service, including its original software, interface, features, and content, is owned by AIVideo or its licensors and is protected by applicable intellectual property laws. Our branding may not be used without our prior written permission.

AI Model Providers

We use third-party AI model and infrastructure providers to deliver parts of the Service. Their availability, processing times, capabilities, and outputs may change and may be subject to their own terms and policies.

Your Rights to Generated Content

Subject to these Terms, your plan, applicable provider terms, and applicable law:

• AIVideo does not restrict you from using generated outputs for lawful personal or commercial purposes
• You are responsible for ensuring your use of generated content complies with applicable laws
• We do not guarantee that generated content is unique, eligible for intellectual property protection, or free from third-party rights or claims

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF CONTENT
• AVAILABILITY OR RELIABILITY OF THE SERVICE

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• AI-generated content will meet your expectations or requirements
• AI-generated content will be unique, accurate, lawful, or suitable for a particular use
• Any errors in the Service will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDEO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
• DAMAGES RESULTING FROM ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
• DAMAGES RESULTING FROM ANY CONTENT OBTAINED FROM THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify, and hold harmless AIVideo and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you create, upload, or generate using the Service

Termination

We may restrict, suspend, or terminate your account or access to the Service when reasonably necessary, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Conduct that creates material legal, security, or operational risk to AIVideo, its providers, or other users

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data in accordance with our Privacy Policy and applicable law
• Provisions that by their nature should survive termination will survive

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by applicable law, without regard to conflict-of-law principles, subject to any mandatory consumer protections that apply in your place of residence.

Before filing a formal claim, you and AIVideo agree to attempt to resolve disputes through good-faith negotiation. If a dispute cannot be resolved informally, it may be brought before a court of competent jurisdiction, subject to applicable law.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any plan-specific terms presented at checkout, constitute the entire agreement between you and AIVideo regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
